That Moment in Time: FRIDAY FOSSICKING 5th April, 2019

US Senators Brian Schatz (D-HI) and Roy Blunt (R-MO) have introduced S 847, the Commercial Facial Recognition Privacy Act of 2019. The bill makes it unlawful for any covered entity to knowingly use facial recognition technology to collect facial recognition data, unless the entity obtains explicit consent from the person after providing notice to them. Covered entities are also required to notify individual when facial recognition data is used or collected.

A covered entity is any person, including corporate affiliates who collect, store, or process facial recognition data. There are exemptions which include, any federal or state or local government, a law enforcement agency, a national security agency or any intelligence agency.

Facial recognition technology analyzes either still or video images of facial features and is used for the unique personal identification of a specific person.

FACEBOOK

Facebook has faced many criticisms and probes by regulators and government agencies across the globe in the past several years. What exacerbated the probes was the Cambridge Analytica scandal where tens of millions of users information was shared with the political consulting firm. "US federal prosecutors are reportedly probing Facebook's data sharing deals with a number of large technology companies. The US Federal Trade Commission is said to be in talks with Facebook over a possible record fine." See:

On March 30 Facebook's CEO Mark Zuckerberg called for four new global regulations governing the Internet recommending rules on :

· harmful content;

· legislation protecting election integrity;

· effective privacy and data protection; and

· data portability.

Zuckerberg said the company is seeking more active roles for governments and regulators. He espoused regulations that would set baselines for prohibited content and require companies to build systems for keeping harmful content to a minimum. He also stated Facebook is creating an independent body so people can appeal our decisions. Furthermore he stated, they are working with governments, including French officials, on ensuring the effectiveness of content review systems.

In the United States technical companies rely on the Communications Decency Act Section 230 which exempts companies from being liable for user-generated content. Zuckerberg's proposes that " regulation could set baselines for what’s prohibited and require companies to build systems for keeping harmful content to a bare minimum."

He said that Facebook would welcome common standards for verifying political actors, citing practices deployed by advertisers in many countries of verifying identities before buying political ads. He also suggested updating laws to include "divisive political issues" in addition to candidates and elections. Zuckerberg also said it would be good if more countries adopted rules for a common framework such as the European Union's General Data Protection Regulation ( GDPR).

Facebook came under criticism recently for livestreaming the Christchurch, New Zealand massacre when 50 Muslims were killed in their mosques. On Thursday, Facebook also stated they would ban white nationalism and separatism from the website. On Friday, in the European Union Countries Facebook started to label political advertisements showing who the advertiser is and how much they paid and who they have targeted. The entire EU Parliament of over 750 members are up for election in May.
