Genealogists love cemeteries and traveling to find ancestors final resting places.   On October 3 the United States Supreme Court heard a case Knick v Township of Scott which should be of interest to genealogists. In this case a landowner doesn't want to comply with a local cemetery-access law and permit genealogists, among others,  on her land to visit graves buried there in a private cemetery.

Mrs. Knick owns the property since 1970 where genealogist Robert Vail found his ancestor Micah Vail is buried. He wants to visit the grave site and honor his ancestor. There are other relatives buried there going back to the Revolutionary War.  While Mrs. Knick denies a cemetery is on her 90-acre property she believes she should be paid by the government or visitors to visit the property.   Under an ordinance in Scott Township, Pennsylvania, landowners must provide daytime access to cemeteries on private land or else face a fine. But Knick, not wanting to open her private property to the public, has refused.

Knick sued the township in 2003 and the Court of Common Pleas dismissed her case as have the US District Court and the Third Circuit Court of Appeals.  She contends the ordinance violates her Fifth Amendment right to "just compensation " for public use of her land.

The US Supreme Court will weigh in on a procedural matter, not whether Vail or others may access the cemetery. The procedural question the Supreme Court will weigh is whether a pre-existing court decision should affect how landowners like Knick file complaints about federal taking claims. Under the Supreme Court’s ruling in Williamson County Regional Planning Commission v. Hamilton Bank (1985), landowners suing about federal land seizures have to go through the state courts before filing in federal courts.

Because of the Williamson decision, Knick was not able to file in federal court as she preferred. For Knick to win the Supreme Court would have to overturn Williamson. A decision is not expected until June 2019.

Access issues to cemeteries vary by state and jurisdiction.  Pennsylvania, for example, mandatesthat property owners grant individuals “reasonable ingress and egress to a burial plot.” (So even if a court strikes down the Scott Township ordinance, Knick may still have to comply with this state law.)

The British Red  Cross Museum and Archives has launched a new online database of historic artifacts. Of the museum's 56,000 items, the database includes 28,752 items, including letters, posters, photographs and films. It covers the past 150 years of work of the British Red Cross. Items will be added to the database if they are permitted to do so under the data protection laws.

The database is searchable by keyword, name, type of object and color.

The British Red Cross previously published a searchable database of records of its First World war –Voluntary Aid Detachments (VADs). 
It is best to search the museum archives database https://museumandarchives.redcross.org.uk/explore and put World War l into the search field.

Proposed Changes to Australian Marriage Certificates will Affect Family Historians Gould Genealogy

This is the short version of what I have written... feel free to adapt it. Do include your contact details, name and address is fine. Make sure you include the link as I suspect many politicians might not know about this...

"As I believe that this applies to all Australians, present and future, I am asking you to consider this submission.

I am one of many who are alarmed at the proposed changes to the marriage forms. 


The changes suggested will certainly affect future family historians, but will also affect many families directly. It is a forgone right to know the names of our ancestors, as well as where they lived, what their occupation was, mother’s maiden name and whether any of the parents of the people concerned are deceased at the time of the marriage.

By simplifying this form, what could possibly be the advantages? As I see it, we will be losing valuable information that can help families trace their ancestors. In today’s society, we are more open to helping adopted people find their biological parents… where there is mutual agreement. This will make that harder.

We are often looking to trace ancestors for knowledge of medical history… this will be much harder, if not nigh impossible to do that.

There are times when we are trying to trace those entitled to an inheritance... marriage certificates, along with other certificates, are invaluable.

We, in Australia, are fortunate to have some of the best certificates in the world. Why change it ?

I would appreciate an acknowledgement and explanation.

The Australia Notice of intended Marriage (NOIM) form is being considered to have changes that are important to genealogists.  

Included in the suggested changes that would eliminate certain information are:

Father's name in full  (if not known write unknown) if deceased add deceased.
Mothers maiden name in full  ( if not known, write unknown, if deceased, write deceased.
Usual place of residence
Usual occupation

Feedback is being requested by the Commonwealth Attorney-General's Department. The deadline is 28 October 2018. To see the notice and  submit comments see: https://www.ag.gov.au/Consultations/Pages/review-marriage-forms-noim.aspx.

The decision to make changes is a result of Marriage Equality Act  as of December 2017 and to streamline the forms. Any change on the NOIM will also impact other official marriage forms, specifically the Official Certificate of Marriage, and the Declaration of No Legal Impediment to Marriage.

Staatsarchiv Hamburg
On September 9  The IAJGS Records Access Alert first reported on the unconscionable destruction of over one million death records by the Staatsarchiv Hamburg. At the time there were few European news articles about this travesty. Since then there have been more news articles and several blog posts by other genealogical writers. 

The IAJGS Public Records Access Monitoring Committee has taken this very seriously.  We have submitted letters to the president of Bundesarchiv even though the structure of the German archives is such that the federal archive, the Bundesarchiv, does not have authority over the state archives such as Hamburg's Staatsarchiv. Additionally, IAJGS submitted letters to the Mayor of Hamburg, the president of the Hamburg Parliament (Buergerschaft) and the Minister of Culture and Media for Hamburg. Our letters expressed our concern over the Destruction and hopes that action will be taken to prevent such action in the future, and to support a commission that would include a genealogist along with historians.
